1. Agreement to These Terms

By creating an account, installing our application, or otherwise accessing the Services, you agree to these Terms. If you are using the Services on behalf of an organisation, you confirm that you have authority to bind that organisation.

2. The Services

Sortiq provides software that helps merchants coordinate customer support, operational workflows, and AI-assisted actions. We may update, improve, or modify the Services from time to time, provided that we will not materially reduce the core functionality of your active subscription.

3. Accounts and Responsibilities

You are responsible for keeping your account credentials secure and for all activity that occurs through your account. You must provide accurate information and promptly notify us of any unauthorised use. You are responsible for ensuring that your users comply with these Terms.

4. Acceptable Use

You may not use the Services to violate applicable law, infringe the rights of others, introduce malicious code, circumvent security measures, or interfere with the operation of the platform. You remain responsible for all data and instructions supplied to the Services.

5. Fees and Payment

Subscription fees are stated in your order, plan selection, or applicable pricing page. Fees are payable in advance and are non-refundable except where required by law or expressly stated otherwise. We may suspend access to the Services for overdue amounts after giving reasonable notice.

6. Customer Data and Privacy

You retain ownership of Customer Data. You grant us the limited rights necessary to host, process, and display Customer Data solely to provide and improve the Services. Our handling of personal data is described in our Privacy Policy and any applicable data processing agreement.

7. Intellectual Property

We and our licensors retain all rights in the Services, including software, interfaces, documentation, and trademarks. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Services during your subscription term.

8. Disclaimers and Limitation of Liability

The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Sortiq will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or business opportunities.

9. Termination

Either party may terminate the subscription in accordance with the applicable plan or order terms. Upon termination, your right to use the Services ends. We will make Customer Data available for export for a reasonable period, subject to applicable law and your account being in good standing.
